Fred Hagans, the Founder and a Partner at the firm, has been trying cases, for both plaintiffs and defendants, since 1972. He began his career with the Houston-based firm, Bracewell & Patterson, L.L.P. after graduating from the University of Texas at Austin. Fred is Board Certified in Personal Injury Trial Law and in Civil Trial Law and is a member of several organizations of trial attorneys, notably, the American Board of Trial Advocates and the National Board of Trial Advocacy. He has served on several committees for the State Bar of Texas and the Houston Bar Association. They include the District 4-B Grievance Committee, the Supreme Court on Professionalism Committee, the Texas Lawyers Creed Committee, and the Texas Supreme Court Task Force Committee for the revision of the Texas Rules of Civil Procedure. He has served as a Special Assistant in the State Bar of Texas Disciplinary Counsel program. He has given many speeches and written many publications pertaining to various issues in trial law. Fred has been appointed to the Judiciary Relations Committee of the State Bar of Texas for the term of 2004-2007. In addition to serving in these Bar-related activities, Fred has served as the Past President of the Gulf Coast Chapter of the Juvenile Diabetes Research Foundation.
Scott Burdine, a Partner at the firm, attended the University of Texas School of Law where he won several moot court and mock trial competitions, was a member of the school National Mock Trial team, and attained membership in the Order of Barristers. Scott has been practicing law since 1985, starting with the Houston-based firm of Vinson & Elkins where he worked on a variety of business transactions in the corporate, real estate, energy and health industry areas. In 1988, at the firm of Hill, Parker, Franklin, Cardwell & Jones, Scott began doing trial work, focusing on the prosecution and defense of clients in a wide variety of business, personal injury and professional malpractice cases. He is Board Certified in Civil Trial Law, is a member of various organizations of lawyers including the Texas and Houston Trial Lawyers Associations and is a frequent speaker on the topic of ethics in the litigation practice. He is a Fellow of the Houston and Texas Bar Foundations. In addition, Scott has been President of the University of Texas Law Alumni Association and has served on the University of Texas Law School Executive Committee since 1993. He is active in the community, having served as President of the West University Little League, a member of the Boards of the West University Little League and Softball Association, and as a little league and soccer coach for his three children.
Kendalll Montgomery, a Partner at the firm, attended the University of Texas Law School where he graduated in 1984 and was a member of the Review of Litigation. Prior to law school, Kendall attended the University of Houston where he obtained his B.B.A. in Finance and graduated cum laude, in 1981. Kendall is licensed to practice in Texas and Ohio. He has been practicing law since 1984, starting his career at Deaton, Briggs & McCain (1984-1990), O'Quinn & Laminack (1991-1999), Kelley & Ryan, P.C. (1999-2001), and is currently practicing law at Hagans, Burdine, Montgomery, Rustay, & Winchester. Kendall is a member of the Houston Bar Association, Ohio State Bar Association, American Bar Association, State Bar of Texas, Association of Trial Lawyers of America, and the Texas Trial Lawyers Association. He is admitted to practice in the 5th Circuit Court of Appeals, U.S. District Court for the Southern, Western and Eastern Districts of Texas and all Texas Courts. His experience as a trial attorney encompasses the areas of commercial litigation, professional liability, and personal injury law.
Jennifer Rustay, a Partner at the firm, began her career with Bracewell & Patterson LLP after graduating from Baylor Law School and clerking for the Honorable Sam Johnson of the United States Court of Appeals for the Fifth Circuit. While in law school, Jennifer was a Notes and Comments Editor for the Baylor Law Review, won awards in mock trial, and served as the President of the Moot Court Society. Today, along with handling a full docket of cases, she serves on the Board of Trustees for the Houston Lawyer Referral Service and the State Bar of Texas Women in the Law Council, chairs the Association of Women Attorneys' Judicial Screening Committee, and speaks frequently at continuing legal education conferences.
Hagans Burdine Montgomery Rustay & Winchester handles civil litigation for both commercial claims and personal injury. In the commercial litigation area, they have successfully handled cases involving intellectual property, contract disputes, insurance coverage and bad faith, shareholder disputes, and employment related disputes. In the personal injury area, they have successfully handled cases involving personal injury and wrongful death where the claims involve product liability, product failures and defects, workplace injuries, vehicle collisions, railroad crossings, and medical malpractice. They have also successfully handled cases involving legal malpractice and defamation.
